Terms and conditions of sale

  • MUSETTI SPA with registered office in Pontenure (PC), Via G. Marcora 2/4, Company Register of the Chamber of Commerce of Piacenza, Tax Code and VAT number 00802420158, hereinafter referred to as ''MUSETTI'';
  • CONSUMER , or pursuant to art. 3, paragraph 1, letter a) of the Consumer Code, the natural person who makes online purchases on the website "for purposes other than any entrepreneurial, commercial, artisanal or professional activity carried out", hereinafter referred to as the ''CUSTOMER''.
  • Furthermore, for those who enter their VAT number during the purchase procedure, considered an indication of the purchase being made for purposes related to business activity, the ordinary provisions of the Civil Code will apply and not this form.
  1. Pre-contractual information for the consumer in distance contracts

Before concluding the purchase contract, the CUSTOMER examines the characteristics of the goods which are illustrated in the individual product sheets at the time of selection.

Before the conclusion of the purchase contract and before the validation of the order with "payment obligation", the CUSTOMER is informed regarding:

  • total price of the goods including taxes, with details of shipping costs and any other costs;
  • payment method;
  • the deadline by which MUSETTI undertakes to deliver the goods;
  • the procedures for exercising the right of withdrawal as well as the standard withdrawal form referred to in Annex I, Part B of Legislative Decree 21/2014;
  • information that the CUSTOMER will have to bear the cost of returning the goods in the event of withdrawal;
  • existence of the legal guarantee of conformity for the goods purchased;
  • after-sales assistance conditions and commercial guarantees provided by MUSETTI.

  1. General conditions of sale, acceptance and modifications

This website www.musettishop.com (hereinafter the "Site") is owned by Musetti SPA, with registered office in Pontenure via G. Marcora 2/4 29010 PC, tax code and registration in the Piacenza Company Register REA PC n 81005 VAT number 00802420158 and is dedicated to the retail sale of coffee, tea and colonial goods and their derivative, similar and complementary products, as well as food products and accessories, the sale of food and non-food goods in any form, the sale or rental of equipment relating to the coffee supply business.

These General Conditions of Sale are drawn up in Italian and English, and regulate the offer and sale of products to the consumer on the website www.musettishop.com: they are prepared in compliance with the principle of consumer protection in accordance with the provisions relating to the distance contract governed by Legislative Decree 9 April 2003, n. 70 containing the regulation of electronic commerce (e-commerce) and by articles 45 et seq. of Legislative Decree 6 September 2005, n. 206 (“Consumer Code”) and subsequent amendments.

The CUSTOMER is required to carefully read these General Conditions of Sale, understanding and accepting them in full without any reservation: pursuant to art. 12, Legislative Decree no. 70/2003 MUSETTI makes the general contract conditions available to the CUSTOMER in such a way that they are allowed to store and reproduce them, as well as all other information that MUSETTI provides on the Site, both before and during the purchase procedure.

The General Conditions of Sale applicable to each individual order will always be those in force and displayed on the site on the date of transmission of the purchase order. MUSETTI reserves the right to make changes or update, in whole or in part, the Conditions of use and sale listed below at any time and in any case in compliance with the legislation in force on the matter. The changes and updates to the Conditions of use will be in force between the parties from the moment of their publication on the Site in this same section and will apply only to sales concluded after the publication itself.

For this reason, the CUSTOMER must consult carefully and diligently, regularly accessing this section to verify the publication of any most recent updates and changes in use.

Detailed information about the details that allow you to contact MUSETTI quickly, also for the purpose of requesting assistance, information or forwarding complaints in reference to the use of the site and purchases made through the site are indicated in the sections: Terms and Conditions of Sale, Privacy & Cookie Policy, Shipping and Payments, Returns, Taxation.

These General Conditions of Sale do not regulate the sale of products and/or the provision of services by parties other than Musetti SpA that are present on the Site via links, banners or other hypertext connections.

The CUSTOMER will be required to verify their conditions of sale before carrying out commercial transactions with such subjects. MUSETTI is not responsible for the sale of products by such third parties and/or for the provision of services, nor for the contents of such sites nor for any omissions and/or violations of the law by the same.

  1. Registration

Registration with username and password is optional. If the CUSTOMER does not wish to register, he/she can still complete a purchase: only the data necessary for the delivery and possible invoicing of an order will be requested.

  1. Features and prices of products or services

Product images may not be perfectly representative of their characteristics but may differ in color, size, accessory products represented. All support information for purchasing is to be understood as simple generic information material, not referable to the real characteristics of a single product. The products are offered at the price indicated on the site on the date an order is placed.

Coffee products are removed from sale 4 months before the expiration date.

For private customers and Italian companies, prices are inclusive of VAT, which will be detailed in the purchase invoice of the product, where issued. For companies with a European VAT number, prices are exclusive of VAT.

Prices do not include shipping and delivery costs which are however indicated in the final section before sending an order and specified in the order receipt confirmation sent via email to the CUSTOMER.

The Products sold on the Site by MUSETTI are original and marked by trademarks owned by the company - and/or licensed to it or in any case with the authorization of the respective owners - and are shipped in their authentic packaging. The essential characteristics of the products are presented on the Site within each product sheet.

All prices shown on the website www.musettishop.com are expressed in Euros and include VAT and, where applicable, the WEEE contribution, and represent the total amount that will be charged at the time of purchase, regardless of the type of customer (private or business).

For companies with a valid VAT number registered in the VIES (VAT Information Exchange System), we apply the reverse charge mechanism. This means that the invoice will be issued without VAT , transferring the obligation to pay the tax to the buyer, as provided for in Articles 194-197 of Directive 2006/112/EC .

Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process and in any case made known to the customer through specific indications on the Site before making the payment.

The products are offered for sale at the price indicated on the Site at the time the relevant Purchase Order is placed.

The CUSTOMER accepts the right of MUSETTI to modify its prices at any time; however, the goods will be invoiced on the basis of the prices indicated on the site at the time of creation of the order and indicated in the confirmation email sent by MUSETTI to the CUSTOMER.

  1. Product Availability

Product availability refers to actual availability at the time the CUSTOMER places the order. Even after the order confirmation email has been sent by MUSETTI, there may be cases of partial or total unavailability of the goods. In this case, without prejudice to the rights granted to the CUSTOMER by the law in force on the matter, the CUSTOMER will be promptly informed by email and will therefore be entitled to immediately terminate the contract. The CUSTOMER who has already made the payment will be promptly refunded the total amount paid, including delivery costs and any other costs incurred, in relation to the order itself.

Any contractual or extra-contractual liability for direct or indirect damages to persons and/or things caused by the failure to accept an order for the reasons stated above is expressly excluded by MUSETTI.

  1. Conclusion and effectiveness of the contract

With these general conditions of sale, MUSETTI sells and the CUSTOMER purchases remotely the tangible movable goods indicated and offered for sale on the site www.musettishop.com. The contract is concluded via the Internet, by the CUSTOMER accessing the address www.musettishop.com and placing the purchase order according to the procedure provided by the site itself, or by calling the toll-free number 800 298 911 .

MUSETTI, before sending the order, informs the CUSTOMER that the conclusion of the contract will be obtained after completing various intermediate technical phases.

  • The CUSTOMER must fill out an order form (hereinafter “Purchase Order”) in electronic format and send it to MUSETTI, electronically, following the instructions that will appear from time to time on the Site and that will accompany the various phases of the purchase;
  • The CUSTOMER undertakes to read, before confirming his/her order, these general conditions of sale, in particular the pre-contractual information provided by MUSETTI and to accept them unconditionally and to observe them in relations with MUSETTI.
  • Orders from persons who have not reached the age of majority will not be accepted.
  • Once payment is confirmed, the order can no longer be cancelled or modified.
  • Once the Purchase Order has been received electronically, MUSETTI, within one day of the conclusion of the procedure, will send the CUSTOMER an "Order Registration Confirmation" email to the indicated email address, which will summarise all the details of the order itself: the CUSTOMER's data and order number, the price of the goods purchased, information relating to the essential characteristics of the product purchased, detailed information on the price, the means of payment used, shipping costs and any additional costs and the delivery address to which the goods will be sent, the information, standard instructions on withdrawal and the standard withdrawal form.
  • The CUSTOMER undertakes to verify the accuracy of the personal data contained therein and to promptly communicate any corrections to MUSETTI.
  • The sales contract is considered concluded and perfected with the electronic sending by MUSETTI to the CUSTOMER of the email confirming receipt of the Purchase Order completed and transmitted by the CUSTOMER.
  • The purchase order form will be stored in the MUSETTI database for the time necessary to execute it and, in any case, within the terms of the law.
  • To access your order form, the CUSTOMER can follow the procedure called "Purchase Orders". To access the order summary, the CUSTOMER can download it within his/her account in the "my orders" section, or by contacting Customer Service by writing an email to customerservice@musetti.it, by calling the toll-free number 800 298 911, or via the online chat located at the bottom right of the site.
  • The languages ​​available to users for the conclusion of the contract are: ITALIAN, ENGLISH, FRENCH and GERMAN. Customer Service is able to communicate with customers in Italian and English.
  • The order sent by the CUSTOMER will be binding for MUSETTI only if the entire order procedure has been completed regularly and correctly without any error messages being highlighted by the Site or not consistent with the commercial policy of these Conditions of Sale, as well as in the event of subsequent unavailability of the products ordered. In the event that MUSETTI is unable to process an order received, it will promptly communicate this to the CUSTOMER specifying the reasons and that the contract has not been concluded: if it has already been concluded, it will be automatically considered terminated, without any charge to the CUSTOMER. Any right of the CUSTOMER to compensation for damages or indemnity is expressly excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things caused by the failure to accept an order by MUSETTI.

  1. Billing

Before completing the order, the CUSTOMER will have the right to request for each order the issuance of a tax invoice for the goods ordered as indicated during the purchase procedure: to follow up on this request, the CUSTOMER will be obliged to communicate to MUSETTI his/her tax code. When ordering, it is necessary to indicate if the shipping address is different from the billing address. The invoice will be available on your tax drawer and can be requested from customer service customerservice@musetti.it .

The invoice will contain the information provided by the CUSTOMER during the purchase procedure. No changes to the data indicated in the invoice will be possible after the invoice has been issued. For anything not specifically described in this paragraph, these Conditions of Sale are reserved and will apply.

  1. Applicable law and competent court

These General Conditions of Sale are subject to Italian law and, in particular, to Legislative Decree no. 206 of 6 September 2005 (so-called Consumer Code), with specific reference to the legislation on distance contracts and Legislative Decree no. 70 of 9 April 2003 on certain aspects concerning electronic commerce.

The competent court for the resolution of any dispute in relation to the application, interpretation and execution of these General Conditions of Sale which cannot be resolved amicably will be that provided for by Italian legislation in force at the time of conclusion of the contract.

The European Commission provides a European Union-guaranteed platform for online dispute resolution, which the CUSTOMER can access via this link .

The online dispute resolution platform can be used in all official EU languages: it offers a range of dispute resolution bodies to choose from which act as an intermediary between the buyer and the trader to resolve the dispute without resorting to legal action.

  1. Responsibility

MUSETTI assumes no responsibility for disruptions attributable to fortuitous events or force majeure, even if dependent on malfunctions and disruptions of the internet network, in the event that it is unable to execute the order within the timeframes set out in this contract.
